This Privacy Policy (hereinafter referred to as the “Privacy Policy”) applies to all information that the website “www.tenderate.eu” (hereinafter referred to as “Tenderate”), located at the domain tenderate.eu (and its subdomains), may collect about the User during the use of the tenderate.eu website (and its subdomains), its programs, and its products.
1. Definitions
1.1 In this Privacy Policy, the following terms are used:
1.1.1. “Site Administration” (hereinafter referred to as the “Administration”) – authorized employees managing the “Tenderate” website, acting on behalf of SIA Tenderate, who organize and/or perform the processing of personal data, as well as define the purposes of personal data processing, the composition of personal data to be processed, and the actions (operations) performed with personal data.
1.1.2. “Personal Data” – any information relating to an identified or identifiable natural person (data subject).
1.1.3. “Personal Data Processing” – any action (operation) or set of actions (operations) performed with personal data, whether automated or non-automated, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, or destruction of personal data.
1.1.4. “Confidentiality of Personal Data” – a requirement for the Operator or any other person who has access to personal data to ensure that personal data is not disclosed without the consent of the data subject or any other legal basis.
1.1.5. “Tenderate Website” – a collection of interrelated web pages hosted on the Internet at the unique address (URL): tenderate.eu, as well as its subdomains.
1.1.6. “Subdomains” – pages or a set of pages located on third-level domains owned by the “Tenderate” website, as well as other temporary pages where the Administration’s contact information is indicated at the bottom.
1.1.7. “Tenderate Website User” (hereinafter referred to as the “User”) – an individual with access to the “Tenderate” website through the Internet who uses the information, materials, and products of the “Tenderate” website.
1.1.8. “Cookies” – a small piece of data sent by the web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time the user attempts to access a page on the corresponding website.
1.1.9. “IP Address” – a unique network address of a node in a computer network through which the User accesses “Tenderate”.
1.1.10. “Product” – a product that the User orders on the website and pays for through payment systems.
2. General Provisions
2.1. The use of the “Tenderate” website by the User signifies agreement with this Privacy Policy and the terms of personal data processing.
2.2. If the User disagrees with the terms of the Privacy Policy, they should cease using the “Tenderate” website.
2.3. This Privacy Policy applies to the “Tenderate” website. SIA Tenderate does not control and is not responsible for third-party websites that the User may access through links available on the “Tenderate” website.
2.4. The Administration does not verify the accuracy of personal data provided by the User.
3. Subject of the Privacy Policy
3.1. This Privacy Policy establishes the Administration’s obligations to maintain confidentiality and ensure the protection of personal data provided by the User at the Administration’s request during registration on the “Tenderate” website, when subscribing to informational email newsletters, or when placing an order.
3.2. Personal data permitted for processing under this Privacy Policy is provided by the User by filling out forms on the “Tenderate” website and includes the following information:
3.2.1. The User’s last name and first name;
3.2.2. The User’s contact phone number;
3.2.3. Email address (e-mail);
3.2.4. The User’s residence address (if necessary);
3.2.5. Delivery address of the Product (if necessary);
3.2.6. The User’s company name (if necessary).
3.3. “Tenderate” protects data that is automatically transmitted when visiting pages:
• IP address;
• Information from cookies;
• Browser information;
• Access time;
• Referrer (address of the previous page).
3.3.1. Disabling cookies may prevent access to parts of the site that require authorization.
3.3.2. “Tenderate” collects statistics on IP addresses of its visitors. This information is used to prevent, detect, and resolve technical issues.
3.4. Any other personal information not specified above (such as browsing history, used browsers, operating systems, etc.) will be securely stored and not disclosed, except in cases provided for in sections 5.2. and 5.3. of this Privacy Policy.
4. Purposes of Collecting Personal Information
4.1. The Administration may use the User’s personal data for the following purposes:
4.1.1. Identifying the User registered on the “Tenderate” website for further authorization, order placement, and other actions.
4.1.2. Providing the User with access to personalized data on the “Tenderate” website.
4.1.3. Establishing feedback with the User, including sending notifications, requests regarding the use of the “Tenderate” website, providing services, and processing User requests and applications.
4.1.4. Determining the User’s location to ensure security and prevent fraud.
4.1.5. Verifying the accuracy and completeness of the User’s personal data.
4.1.6. Creating an account for using parts of the “Tenderate” website if the User has consented to the creation of an account.
4.1.7. Notifying the User via email.

4.1.10. Conducting promotional activities with the User’s consent.
5. Methods and Terms of Processing Personal Information

5.2. The User agrees that the Administration has the right to transfer personal data to third parties, including courier services, postal organizations (including electronic), telecommunications operators, solely for the purpose of fulfilling the User’s order placed on the “Tenderate” website, including product delivery, documentation, or email messages.
5.3. The User’s personal data may be transferred to authorized government authorities only on the grounds and in the manner established by law.
5.4. In the event of loss or disclosure of personal data, the Administration has the right not to inform the User of the loss or disclosure of personal data.
5.5. The Administration takes necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, and other unlawful actions by third parties.
5.6. The Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.
6. Rights and Obligations of the Parties
6.1. The User has the right to:
6.1.1. Make a free decision to provide their personal data necessary for using the “Tenderate” website and consent to its processing.
6.1.2. Update or supplement the provided personal data if such information changes.
6.1.3. The User has the right to obtain information from the Administration regarding the processing of their personal data, unless such right is restricted in accordance with federal laws. The User has the right to require the Administration to clarify their personal data, block, or destroy it if the data is incomplete, outdated, inaccurate, illegally obtained, or not necessary for the stated purpose of processing, as well as to take legal measures to protect their rights.
6.2. The Administration is obliged to:
6.2.1. Use the received information solely for the purposes specified in Section 4 of this Privacy Policy.
6.2.2. Keep confidential information secret, not disclose it without the User’s prior written consent, and not sell, exchange, publish, or otherwise disclose the User’s personal data except as provided in sections 5.2 and 5.3. of this Privacy Policy.
6.2.3. Take precautions to protect the confidentiality of the User’s personal data in accordance with the procedures typically used to protect such information in the existing business environment.
6.2.4. Block the personal data related to the relevant User upon their request or the request of their legal representative or authorized personal data protection authority during the verification period, in case of identification of inaccurate personal data or unlawful actions.
7. Liability of the Parties
7.1. The Administration, failing to fulfill its obligations, is liable for any damages incurred by the User due to unlawful use of personal data, in accordance with the law, except in cases provided for in sections 5.2., 5.3., and 7.2. of this Privacy Policy.
7.2. In the event of loss or disclosure of confidential information, the Administration is not liable if such information:
7.2.1. Became public knowledge before its loss or disclosure.
7.2.2. Was received from a third party before it was received by the Administration.
7.2.3. Was disclosed with the User’s consent.
7.3. The User is fully responsible for complying with the laws, including advertising laws, copyright and related rights protection laws, trademark and service mark protection laws, among others. The User also bears full responsibility for the content and form of materials posted on the site.
7.4. The User acknowledges that responsibility for any information (including, but not limited to: data files, texts, etc.) accessible as part of the “Tenderate” site rests with the person who provided such information.
7.5. The User agrees that information provided to them as part of the “Tenderate” site may be intellectual property protected and owned by other Users, partners, or advertisers who post such information on the “Tenderate” site. The User may not alter, lease, lend, sell, distribute, or create derivative works based on such content (in whole or in part), except where such actions are expressly permitted by the owners of such content in accordance with the terms of a separate agreement.
7.6. Regarding text materials (articles, publications) available in the public domain on the “Tenderate” site, distribution is allowed provided that a link to “Tenderate” is given.
7.7. The Administration is not liable to the User for any loss or damage incurred by the User due to the deletion, failure, or inability to save any content and other communication data contained on the “Tenderate” site or transmitted through it.
7.8. The Administration is not liable for any direct or indirect losses resulting from: the use or inability to use the site or any services; unauthorized access to User communications; statements or behavior of any third party on the site.
7.9. The Administration is not liable for any information posted by the User on the “Tenderate” site, including, but not limited to: information protected by copyright, without the direct consent of the copyright holder.
8. Dispute Resolution
8.1. Before filing a lawsuit regarding disputes arising from the relationship between the User and the Administration, it is mandatory to submit a complaint (written proposal or electronic request for voluntary settlement of the dispute).
8.2. The recipient of the complaint must notify the complainant in writing or electronically of the results of the complaint review within 30 calendar days from the date of receipt of the complaint.
8.3. If an agreement is not reached, the dispute will be referred to the court of the city of Riga.
8.4. This Privacy Policy and the relationship between the User and the Administration are governed by the applicable law.
9. Additional Conditions
9.1. The Administration reserves the right to make changes to this Privacy Policy without the User’s consent.
9.2. The new Privacy Policy takes effect from the moment it is posted on the site, unless otherwise specified in the new version of the Privacy Policy.
